Chayei Sarah: Sarah Imeinu was not the rabbinic paradigm of a perfect woman, but a real woman.

Chayei Sarah – Domestic Abuse in Judaism

The International Day for the Elimination of Violence against Women is on 25th November, days after we will have read the parasha detailing the death and burial arrangements for the first biblical matriarch, Sarah Imeinu.

The Declaration on the Elimination of Violence Against Women issued by the UN General Assembly in 1993, defines violence against women as “any act of gender-based violence that results in, or is likely to result in, physical, sexual or psychological harm or suffering to women, including threats of such acts, coercion or arbitrary deprivation of liberty, whether occurring in public or in private life.” It includes such acts as intimate partner violence (battering, psychological abuse, marital rape, femicide);   sexual violence and harassment (rape, forced sexual acts, unwanted sexual advances, child sexual abuse, forced marriage, street harassment, stalking, cyber- harassment);     human trafficking (slavery, sexual exploitation);     female genital mutilation; and  child marriage.

Sarah is introduced to us as the wife of Abraham. Whether she was his niece, his half-sister, or any other relation to him is unclear – but we are not told directly of her antecedents, simply that he takes her for a wife (Genesis 11:29) around the same time that Abraham’s brother Nahor also takes a wife, after the death of Haran their other brother.  The second thing we know about Sarah is that she is unable to conceive a child.

It is not very promising stuff. Here is a vulnerable woman who is married into a “patriarchal family” with a husband ten years older than her, and who is unable to do the one thing expected of her – to produce an heir.  This is a particular trauma given that her husband has been promised to have innumerable descendants – it is almost as though they are being set up against each other, with no possibility of resolution.

Taken yet again from her settled place she and her husband travel to Canaan, and because of the severe famine there ,onward to Egypt, where she is described as her husband’s sister in order to protect his life. The consequence is that she is taken into the harem of Pharaoh, and while we have many midrashim designed to protect her purity and good name, we have no idea what happened to her there – only that Pharaoh gave her back along with material compensation to her husband, after a series of events which he rightly understood to be divine warnings.

After ten years of living in the land, with no sign of a child to fulfil the divine promise, Sarah does what many a female figure in bible will do after her – intervene in order to bring about that which is expected to happen. In this case she hands over her Egyptian maid to her husband in order for him to have a child. While there are those who might see this as a wonderful wifely and unselfish gift, the clear light of day shows otherwise. Ten years of marriage with no child – this becomes grounds for divorce (Mishnah Yevamot 6:6) – and would leave a woman without family to take her in, unprotected socially and economically. Sarah uses another woman to give her husband the child he desires so much, and in so doing causes greater anguish for Hagar, for Ishmael, for Abraham and for herself. One could argue that the pain this intervention caused resonates to this day.

After the birth of Ishmael the relationship between the two women breaks down completely. Sarah mistreats Hagar, Hagar runs away from home but returns – she has nowhere else.  Ishmael and Hagar are banished causing pain to them both and to Abraham who will not know the outcome of their story, Isaac inherits family trauma he cannot begin to understand.

The birth of Isaac is told in quasi miraculous terms. Abraham and Sarah are old, she is clearly post-menopausal. When God tells Abraham there will be another child he laughs, reminds God he is 100 years old and Sarah 90, and pleads for Ishmael to be his heir, only to be told that the promised  child and heir to the covenant will indeed be Sarah’s, though Ishmael will be looked after too.

When God tells Sarah, she too laughs, and she is more direct with God – after she is so old would she have such pleasure?  she asks. And her husband is too old too, she reminds God. (Genesis 18:12)

God then does something extraordinary. His report back to Abraham Sarah’s inner narrative voice, but he alters it. Instead of the clear message that Sarah has given up hope of such pleasure because her husband is too old, God transposes the person – telling Abraham that Sarah laughed because she feels herself to be too old.

This transposition is the origin of the rabbinic idea of Shalom Bayit – of marital harmony, the telling of small innocent lies in order to keep the peace. The idea that somehow the woman has to disproportionally protect the feeling of the man has become embedded into what might otherwise be a laudable aim. And sadly, Shalom Bayit has become the carpet under which domestic abuse has been brushed all too often down the generations.

Sarah has become the paradigm for the ideal woman for rabbinic Judaism in other ways too – when the visitors arrive o announce the birth of Isaac, Sarah is hidden away inside the tent, her husband facing the world. It is he who hurries around being hospitable, she who bakes the bread for the visitors.   Later we will be told that when Isaac marries Rebecca he takes her to his mother’s tent and is comforted and the midrash (Bereishit Rabbah 60:16) will teach “Three miraculous phenomena that occurred in the tent during Sarah’s lifetime returned when Isaac married Rebecca: the Shabbat candles remained lit from one Friday to the next, the challah dough was blessed and was always sufficient for the family and guests, and the Divine cloud hovered over the tent.”  The rabbinic tradition generally understand this as showing that Rebecca was, like Sarah, a good and faithful homemaker, their role limited to baking and cleaning and preparing the home.  At least one contemporary – and female – commentator, has a different, and in my view more likely view of the meaning. Tamara Frankiel suggests that the midrash is commenting on the intrinsic holiness of the first two matriarchs, such that the wherewithal for Shabbat and the divine presence were always on hand, rather than that the two women were particularly devoted to housework. She comments also that the description of the tent here is a parallel to the later Temple where the ner tamid was always burning, the 12 loaves of showbread always fresh and present in front of the Ark of the Covenant.  (The Voice of Sarah: Feminine Spirituality and Traditional Judaism).

The roles ascribed by the rabbinic tradition to Sarah and the other matriarchs – maternal, wifely, home making, providing the resources of hospitable giving while not actually being present when guests come – these are not the roles given in the biblical texts. And the male gaze through which we generally see these women who clearly have confidence and agency in their own lives when seen in bible, has layered both them and the expectations of subsequent generations with an impossible and also undesirable aura.

Sarah does not put herself down when contemplating a child, she is realistic about her chances, the idea of an unexpected pleasure long forgotten, the changes age has wrought to her, and to her husband. She does nothing towards Shalom Bayit here – it is the rabbinic extension of God’s comments which brings us this view of her as a woman who would subjugate herself for her husband’s feelings. Equally there is nothing in the text to suggest she is subjugating herself when presenting Hagar to her husband in order for him to get a child – if anything the power is all hers, as we see in her response when there is a dilution of that power relationship.  When she takes charge of Hagar once more, even God tells Abraham to listen to her voice and do what she says, something that remarkably has little traction in the male world of traditional rabbinic texts.

Women in the Jewish community are as likely to be the victims of domestic abuse as women in the wider community – about one in four will experience it. Women in the Jewish community are increasingly being constrained and lectured about “Tzniut”, seemingly understood about women’s bodies and actions only, although most certainly in its earlier meanings tzniut is about humility for both men and women.

Women in the Jewish community are at a disability according to halachah – unable to initiate the religious divorce document of Gittin for example. Increasingly the halachah is being reworked to push women out of the public space, to try to remove and hide women’s voices from the discourse, to push some cultural attitudes as if they are legal ones.  And so often Sarah Imeinu is cited – the perfect female paradigm in the minds of the rabbinic tradition, but actually a real woman who develops her own agency and power, who sees the frailties of her husband, who intervenes in history and who laughs disbelievingly at God.

As we mark the day that reminds us of how women have become so vulnerable to male violence that there needs to be an international policy to try to shape a different world, let’s take a moment to see the real Sarah Imeinu, the woman who originally belongs to no man in bible, who marries Abraham and helps him in his life’s work, travelling with him and sharing his destiny, working as part of a team, and subservient to no one.

Chayei Sara – Abusi domestici nell’ebraismo

 

La Giornata internazionale per l’eliminazione della violenza contro le donne sarà il 25 novembre, qualche giorno dopo che avremo letto la parashà che illustra in dettaglio la morte e le disposizioni di sepoltura per la prima matriarca biblica, Sara imeinu.

La Dichiarazione sull’eliminazione della violenza contro le donne emessa dall’Assemblea generale delle Nazioni Unite nel 1993, definisce la violenza contro le donne come: “qualsiasi atto di violenza di genere che provochi, o rischi di provocare, danno o sofferenza fisica, sessuale o psicologica alle donne, comprese le minacce di tali atti, la coercizione o la privazione arbitraria della libertà, che si verifichino nella vita pubblica o privata”. Ciò include atti quali violenza del partner nell’intimità (percosse, abusi psicologici, stupro maritale, femminicidio), violenza e molestie sessuali (stupri, atti sessuali forzati, profferte sessuali indesiderate, abusi sessuali su minori, matrimonio forzato, molestie stradali, stalking, cyber-molestie), tratta di esseri umani (schiavitù, sfruttamento sessuale), mutilazione genitale femminile e matrimonio infantile.

Sara ci viene presentata come la moglie di Abramo. Se fosse sua nipote, la sua sorellastra o se avesse qualsiasi altra relazione con lui non è chiaro, niente ci viene detto direttamente dei suoi antecedenti, ma semplicemente che lui la prende per moglie (Genesi 11:29) nello stesso periodo in cui anche Nahor, fratello di Abramo, prende moglie, dopo la morte di Haran, l’altro loro fratello. La seconda cosa che sappiamo di Sara è che non è in grado di concepire un bambino.

 

Non è materiale molto promettente. Ecco una donna vulnerabile che è sposata in una “famiglia patriarcale” con un marito di dieci anni più grande di lei, e che non è in grado di fare l’unica cosa che ci si aspetta da lei: produrre un erede. Questo è un trauma specifico, dato che a suo marito è stato promesso di avere innumerevoli discendenti: è quasi come se fossero stati messi l’uno contro l’altro, senza possibilità di soluzione.

 

Allontanata ancora una volta dal posto dov’era stabilita, lei e suo marito viaggiano verso Canaan e, per la grave carestia lì presente, di nuovo verso l’Egitto, dove viene presentata, per proteggere la sua vita, come sorella di suo marito. La conseguenza è che viene portata nell’harem del Faraone e mentre abbiamo molti midrashim progettati per proteggere la sua purezza e il suo buon nome, non abbiamo idea di cosa lì le sia successo, solo che il Faraone la ha rimandata indietro unitamente a una compensazione materiale per suo marito, dopo una serie di eventi da lui giustamente intesi come avvertimenti divini.

 

Dopo dieci anni di vita nella terra, senza alcun segno di un bambino che mantenga la promessa divina, Sara fa ciò che molte figure femminili nella Bibbia faranno dopo di lei: interverranno per realizzare ciò che dovrebbe accadere. In questo caso, consegna la sua cameriera egiziana a suo marito per avere un figlio. Mentre c’è chi potrebbe vedere ciò come un dono meraviglioso e disinteressato, la chiara luce del giorno mostra il contrario. Dieci anni di matrimonio senza figli: questo diverrebbe motivo di divorzio (Mishnah Yevamot 6:6) e potrebbe lasciare una donna senza una famiglia ad accoglierla, non protetta socialmente ed economicamente. Sara usa un’altra donna per dare a suo marito il figlio tanto desiderato, e così facendo provoca maggiore angoscia per Hagar, per Ismaele, per Abramo e per se stessa. Si potrebbe sostenere che il dolore causato da questo intervento risuona fino ai giorni nostri.

 

Dopo la nascita di Ismaele il rapporto tra le due donne si interrompe completamente. Sara maltratta Hagar, Hagar scappa di casa ma torna: non ha nessun altro. Ismaele e Hagar sono banditi causando dolore a entrambi e ad Abramo, che non conoscerà l’esito della loro storia, Isacco eredita un trauma familiare che non può iniziare a capire.

 

La nascita di Isacco è raccontata in termini quasi miracolosi. Abramo e Sara sono vecchi, lei è chiaramente in post-menopausa. Quando Dio dice ad Abramo che ci sarà un altro bambino egli ride, ricorda a Dio che ha cento anni e Sara novanta e supplica perché il suo erede sia Ismaele, solo per sentirsi dire che il figlio promesso ed erede dell’alleanza sarà davvero di Sara, anche se di Ismaele si avrà comunque cura.

 

Quando Dio parla a Sara, anche lei ride, è più diretta con Dio e gli chiede: adesso che è così anziana avrebbe tale piacere? E anche suo marito è troppo vecchio, ricorda a Dio. (Genesi 18:12)

 

Dio quindi fa qualcosa di straordinario. Riporta ad Abramo la voce narrativa interiore di Sara, ma alterandola. Invece del chiaro messaggio che Sara ha rinunciato alla speranza di tale gioia perché suo marito è troppo vecchio, Dio traspone la persona, dicendo ad Abramo che Sara ha riso perché lei si sente troppo vecchia.

 

Questa trasposizione è l’origine dell’idea rabbinica di Shalom Bayit di armonia coniugale, il racconto di piccole bugie innocenti per mantenere la pace. L’idea che in qualche modo la donna debba proteggere in modo sproporzionato il sentimento dell’uomo si è radicata in quello che altrimenti potrebbe essere un obiettivo lodevole. E purtroppo, Shalom Bayit è diventato il tappeto sotto cui gli abusi domestici sono stati spazzati via troppo spesso lungo le generazioni.

 

Sara è diventata il paradigma della donna ideale per l’ebraismo rabbinico anche in altri modi: quando i visitatori arrivano o annunciano la nascita di Isacco, Sara è nascosta nella tenda, suo marito affronta il mondo. Lui si affretta a essere ospitale, lei cuoce il pane per i visitatori. Più tardi ci verrà detto che quando Isacco sposa Rebecca la porterà nella tenda di sua madre e verrà  confortata e il midrash (Bereishit Rabbà 60:16) insegnerà: “Tre fenomeni miracolosi verificatesi nella tenda, durante la vita di Sara, tornarono quando Isacco sposò Rebecca: le candele di Shabbat rimasero accese da un venerdì all’altro, l’impasto della Challà fu benedetto e fu sempre sufficiente per la famiglia e gli ospiti, e la nuvola divina si librò sopra la tenda”. La tradizione rabbinica generalmente lo interpreta mostrando che Rebecca fu, come Sara, una buona e fedele casalinga, il loro ruolo è limitato alla cottura, alla pulizia e alla preparazione della casa. Almeno un commentatore contemporaneo, e femminile, ha una visione diversa e, a mio avviso, più probabile del significato. Tamara Frankiel suggerisce che il midrash stia commentando l’intrinseca santità delle prime due matriarche, in modo tale che il necessario per Shabbat e la presenza divina fossero sempre a portata di mano, piuttosto che le due donne fossero particolarmente dedite alle faccende domestiche. Commenta anche che la descrizione della tenda qui è parallela al successivo Tempio, dove il ner tamid bruciava costantemente, i dodici pani dell’offerta erano sempre freschi e presenti davanti all’Arca dell’Alleanza. I ruoli attribuiti dalla tradizione rabbinica a Sara e alle altre matriarche: materno, coniugale, casalingo, fornire le risorse dell’ospitalità ma non realmente presenti quando gli ospiti arrivano, non sono ruoli assegnati nei testi biblici. E lo sguardo maschile attraverso il quale generalmente vediamo queste donne, che godono chiaramente di fiducia e libero arbitrio nella propria vita se viste nella Bibbia, ha stratificato sia loro che le aspettative delle generazioni successive con un’aura impossibile e anche indesiderabile.

 

Sara non si mortifica quando prende in considerazione l’idea di avere un bambino, è realista riguardo alle proprie possibilità, all’idea di un piacere inaspettato dimenticato da tempo, ai cambiamenti che l’età ha portato a lei e a suo marito. Non fa nulla per la Shalom Bayit, è l’estensione rabbinica dei commenti di Dio che ci porta questa visione di lei come di donna che si soggiogherebbe per i sentimenti di suo marito. Allo stesso modo non c’è nulla nel testo che suggerisca che si soggioghi quando presenta Hagar a suo marito per fargli avere un figlio: semmai il potere è tutto in mano sua, come vediamo dalla sua reazione quando c’è un indebolimento di quella forte relazione. Quando si prende di nuovo carico di Hagar, anche Dio dice ad Abramo di ascoltare la sua voce e fare ciò che dice, qualcosa che ha straordinariamente poca popolarità nel mondo maschile dei testi rabbinici tradizionali.

 

Le donne nella comunità ebraica hanno le stesse probabilità di essere vittime di abusi domestici delle donne nella comunità più ampia, circa una su quattro li sperimenterà. Le donne nella comunità ebraica sono sempre più costrette a tenere conferenze sulla “Tzniut“, apparentemente intesa solo riguardo i corpi e le azioni delle donne, anche se certamente, nei suoi primi significati, la tzniut riguardava l’umiltà sia per gli uomini che per le donne.

 

Secondo l’halachà, le donne nella comunità ebraica sono incapaci: incapaci, per esempio, di intraprendere il documento di divorzio religioso di Gittin. Sempre più la halachà viene rielaborata per spingere le donne fuori dallo spazio pubblico, per cercare di rimuovere e nascondere le voci delle donne dal discorso, per sostenere alcuni atteggiamenti culturali come se fossero legali. E così, spesso, viene citata Sara imeinu: il paradigma femminile perfetto nelle menti della tradizione rabbinica, ma in realtà una vera donna che sviluppa il proprio agire e il proprio potere, che vede le fragilità di suo marito, che interviene nella storia e che ride incredula di Dio.

 

Mentre segniamo il giorno che ci ricorda come le donne siano diventate tanto vulnerabili alla violenza maschile da dover esserci una politica internazionale per cercare di plasmare un mondo diverso, prendiamoci un momento per vedere la vera Sara imeinu. La donna che non appartiene in origine a nessun uomo nella Bibbia, che sposa Abramo e lo aiuta nel lavoro della sua vita, viaggiando con lui e condividendo il suo destino, lavorando come parte di una squadra e non servendo nessuno.

Tamar: taking her destiny in her own hands she will enable the messiah. Parashat Vayeshev

judah-and-tamar-chagallInserted into the Joseph narratives that take up much of the last half of the book of Genesis, is a chapter about Judah and about his family. It is also a chapter about the actions of a woman who is determined to right a wrong and how she achieves this goal. Situated as it is so discordantly in the Joseph narrative it is easy to turn the page, to ignore the text as we continue to read about Joseph’s troubles and his subsequent elevation. Because it deals with sexual acts, and with apparent impropriety, it is studied much less than it should be. The lens of the narrator is narrow, detail is sparse, but it is a text worth a great deal of attention, for it reminds us that in bible the women were actors in the story and not observers, they were out in the public space, their behaviour often created pivots in the chronicle. The story of Judah and Tamar shouts out “notice me” – the sons of Jacob are yet again challenged by a woman and this time they cannot cheat her or hide from her or marginalise her. Tamar is a risk taker while all the time behaving within the law. She is a model for modern Jewish women, her story reminds us our destiny is in our own hands.

Judah leaves his brothers and marries a Canaanite woman, the unnamed daughter of Shua, and has three sons: Er, Onan and Shelah.  Without comment from the narrator, time passes and he takes a wife for his first born son -Tamar. What do we know about her? Her antecedents are shrouded in mystery though we may assume that she was also a Canaanite woman. There is one tradition that suggests that she is the daughter of Malchitzedek, King of Shalem and Priest to the Most High God, and certainly she behaves in a way that bespeaks confidence and determination to get her rights fulfilled.

Tamar is married to Er, who was “wicked in the sight of God, and God killed him” (38:8). She was then married to his younger brother Onan, specifically (and anachronistically) for him to perform the act of yevamah, to provide a child who would legally be the child of the dead and childless Er.

But Onan knew that the child would not be formally his, as so when he went to her he deliberately spilled his semen on the ground rather than create a child who would inherit the portion of his dead brother, and the bible tells us “Vayera b’eynei Adonai asher assah vayamet gam oto: The thing that he did was evil in the sight of God, and he killed him too” (v10)

What did Er do that was so wicked he deserved to die? Bible doesn’t tell us. While there is a strand of tradition that suggests that the boys die as punishment for the wickedness of their father, so that he should feel the pain of the death of a child as he had caused his father to feel that grief when he did not protect Joseph, the general consensus of tradition is that the sin must have been Er’s and must have been similar to that of his brother. Hence one Midrash suggests that he did not want Tamar to spoil her beauty by becoming pregnant and therefore his relations with her were designed to prevent pregnancy. This I think tells us much more about the commentators than it does about the text, but the reality is that he does not provide a child for his wife before his sudden death.

Onan’s wickedness however is clear, and it is not the sin that bears his name. It is not the spilling of the seed that was the real problem in God’s eyes, it was the fact that he did not want to give his dead brother a stake in the future, a child who would inherit both the name and the material benefit that would have belonged to Er. He denied his dead brother an heir and he denied his wife the protection that having the child would give her.

What we are told and what we are not told in this text is fascinating. The bible is keen to make sure we know that Judah has left his brothers, that he has built a deep friendship with Hirah an Addullamite (va’yet). It tells us of his Canaanite wife bat Shua and his children with her. It tells us that the action takes place in Chezib – and here is the clue to the whole sorry tale, for the name Chezib comes from the root-verb כזב (kazab), meaning to lie, to disappoint, to fail. As an idiom the word is also used to describe a brook or stream that has dried up – a river that disappoints, rather than one that will provide water. Judah has three sons, and yet the likelihood of his having descendants after them diminishes as the disappointment and the lies build up.

The bible signals that the story is about deceptions and disappointment, and Judah as the fourth son of Jacob and Leah is born into deception and disappointment, even while he will ultimately become the ancestor par excellence, the tribe from whom we will descend.

After the deaths of the two older sons, Judah tells Tamar to “stay a widow in the house of your father until Shelah my son grows up” Assuming the practise of yevamah, this appears to be a reasonable request, though why Tamar is kept in her father’s house rather than that of her in-laws bears further examination. But it seems that he is trying to keep her at a distance, for bible continues that same verse with the words “Lest he also die like his brothers”.

The superstition that a woman who loses more than one husband is somehow responsible is dangerous and a killer of men who come close to her has deep roots. It is a classic example of blaming the victim. Widows were economically and socially vulnerable, classed in bible along with orphans and strangers in the land/refugees. There are many exhortations to protect the widows in biblical texts, but in this story in the first book of Genesis, before Torah had been given and before its challenge to established norms, the superstition drives Judah, and sadly his behaviour means that the idea of the “black widow” has permeated into our awareness too.

Widowed now himself, Judah goes to see his great friend Hirah in Timnah. We do not know how much time has passed but Tamar is able to observe for herself that Shelah has grown up and that he has not been given to her as a husband in order to both provide a child in his brother’s names. Tamar is trapped in a situation that does not allow her to marry within the family of Judah nor to marry anyone else. She must feel desperate.

Judah doesn’t tell Tamar that he is travelling near to where she is. He has left her exiled in her father’s home living as a widow and he seems to have no communication with her, nor any interest in her continued well-being.  Someone unnamed tells her that Judah will be travelling through and Tamar takes her chance.

She removes the widow’s weeds she is wearing and covering herself with her veil she sits “petach Einayim” – which could mean “at the entrance to Einayim” but which also means “at the opening of the eyes”. This is a pivot in the story. There has been up till now lies and deception, the suppressing of the reason that God found Er wicked, the betrayal by Onan of his brother’s rights to the future.   Tamar has been hidden from sight in the household of her father, there is no communication between the two households, she is out of sight and out of mind. But here she is, sitting by the roadway Judah will travel, determined to be noticed, to open Judah’s eyes to the injustice done to her.  Her action is eye opening.

Judah certainly sees her. He notices her. At least, he notices there is a woman there and he makes the assumption that she is a prostitute. And the reason for this? Because her face is covered.  Think about this. He reaches his conclusion that this is a woman available for hire for sexual relief because her face is covered. In today’s world a veiled face is supposed to designate modesty, protecting the beauty of the woman from the crassness of the world – yet here in bible the clear assumption is that the veiled face designates woman only as object. She stops being a person. She doesn’t exist as living breathing yearning thinking woman. She is a prostitute, available for the pleasure of men who pay. There is at least some honesty in this approach – the reality of the woman is unimportant in the world of the biblical text, who she is is irrelevant to the man who buys her. In today’s world of extreme tzniut used to oppress women in some communities, the deception is back. Telling women that their covered state and hiddenness from the public space is a way of increasing their holiness, protecting their modesty etc is a lie to hide the fact that their very self is being controlled by others, to keep them as possessions and as subjects rather than as active and authentic people with their own agency.

Judah is polite, he speaks to her with courtesy, not knowing who she is at all. The same verb is used as with his relationship with Hirah – vayet eleha – he turns to her. This could be the beginning of a real connection, but it is not because he does not see someone with whom connection can be made. He sees only the possibility of a sexual moment and this is what he asks for. So she begins the negotiation “what would you give me in payment for sex?” He offers her a future payment, a young kid from the flock, and she counters with the request for a pledge that she can keep until such time as the payment is made. It seems that Judah is unused to this type of negotiation. He asks her what such a pledge should be and she requests three deeply personal and unique items that will be recognisable and indisputably his.  Having given them to her, they have intercourse and Tamar conceives at last.

The interlude over, she leaves and removing the veil she puts on her widows weeds once again. Judah keeps his promise, sending the animal as promised with Hirah his friend, and expecting the return of his pledge, but she is gone, and when Hirah asks around where the prostitute who had been sitting there was, the response is that there had been no prostitute. This he relays to Judah, who doesn’t seem to be at all perturbed by the woman’s disappearance with his personal possessions, and seems rather to hope that by ignoring what has happened he will escape any shame. But how can he just leave his pledge, his signet, cords and staff, as if nothing has happened?  These days we might call it identity theft, we would desperately search for our missing items and try our best to make good the loss. Judah’s response “tikach la, pen nihyeh lavuz” is more than laconic, it is negligent and it is fearful of any shame attaching to him and his friend. Why?

Three months later the news reaches Judah that Tamar is pregnant, and the assumption is that she has prostituted herself. No communication has happened between the two as yet and when she is brought to Judah in order to be punished by burning, she still does not immediately identify the father by name. Instead there is a sort of choreography – she is brought to the household of Judah from her father’s house. She does not appear to meet Judah, instead she sends the pledged items he had given her and says “Clarify please whose are these tokens? The signet the cords and the staff?” It is of course a rhetorical question but it is a dangerous one. For a man who had been trying to avoid shame, Judah could have taken and sequestered the items. She would have been burned to death along with her unborn children. But instead he acknowledged them and speaks of the justice and rightness of Tamar’s act – she had simply been trying to fulfil the requirement for a child for his two dead sons, and in doing that to protect her own vulnerable situation too.

Like Rebecca, Tamar has twins. Like her too the birth is eventful – the first child puts out a hand and then withdraws it but not before a scarlet thread has been tied around it, the second child is then born, and the elder one is fully born second. Their names are given, but not it seems by Tamar. The elder child is named Zerach which means brightness or shining. The younger is Perez – meaning to burst forth, to breach. There are many echoes of Rebecca here, the colour red, the description of the older child in terms of his appearance and the younger in terms of his actions.  There is a clear subtext that these children were designed to be born, they are necessary in terms of the biblical narrative. They would not have been born had Judah followed his plan to keep Tamar in purdah to protect his one surviving son from what he saw was her danger – a superstition roundly exploded in the story, for Judah is not endangered by his encounter with Tamar.

The story is tidied up – both dead brothers have a child to take their place in history. Tamar does not need to marry again, her status is established. Judah has come to realise that his behaviour was not as righteous as that of his Canaanite daughter in law and has acknowledged this.  But the questions arising from the story only multiply. Why this story at all? Why put it here in the Joseph narratives? Why did the children need to be born?

One question is partially answered in the genealogical line given in the book of Ruth, the Moabite woman who also took her status as childless widow into her own hands and had a child by a family member of her dead husband in order both to honour his future and to protect her own vulnerable status. We will learn from this genealogy that King David will descend from the line of Perez – that both Tamar the Canaanite woman and Ruth the Moabite woman will pivot history in order to bring about the birth of the messianic line.   But why does King David and why will his messianic descendant need to be born of such deceptive sexual encounters orchestrated by the women? This is a question yet to be satisfactorily answered.

Why is it in the Joseph narrative? With the themes of clothing to hide identity, of deception and betrayal, of promises made and not kept and of the painful loss of children, with mis-communication and with the lack of communication, with fear and shame and hopelessness and exile –  there is much to connect these narratives.  But Tamar herself is not echoed in the Joseph stories, except maybe in parody when the wife of his master desires him and lies that he tried to sleep with her. Tamar stands alone in these narratives, a woman who is married twice to unworthy and wicked men yet who retains her own integrity and keeps her eye on the future. Blamed as a husband killer when we know from bible that God kills the men because of their wickedness, exiled to her father’s house and marginalised from the narrative, she uses her marginal status and plays out the scene whereby she becomes not-woman, a body, a prostitute for hire at the roadside, and moves her descendants into the centre of the narrative.

One of my favourite lines of any film comes in “My big fat Greek Wedding”. It tells the story of a woman of Greek descent trying to find herself and her place in society outside her father’s home and the struggles she endures as she grows. Her father makes a decree about her future and she is despondent. Her mother tells her that indeed she must obey, the father is the head of the house. In their culture, his word is law. But the mother goes on to say, the father is the head but the mother is the neck, and the head points whatever way the neck dictates.  It speaks to me of biblical narrative, when the men make the decisions and hold the power, but with great regularity the women subvert that decision making, and from Sarah, Rebecca, Rachel and Leah onwards they gently manipulate in order to produce the desired outcome. The list of these women in bible is long, yet often they escape our attention as they escape the attention of the men with whom they live. Tamar is a rare exception – by getting herself noticed she will disrupt the course of the narrative and change history.

Women in Public Space – a proud Jewish tradition in danger of being forgotten

Where has it come from, this strident male voice insisting that women are so dangerous that they must neither be seen nor heard? When did woman, created equally and simultaneously alongside man in the first creation story  (Genesis 1:27) lose that position in the eyes of some commentators so that they not only feel the need to hide women away from the public eye and mute our voices, but go on to claim that this is God’s will as indicated in bible? And then, for good measure, decree that women cannot study these texts for reasons of modesty?

The position of women in Judaism is under assault and despite what some may say, this is essentially a modern phenomenon. Biblical women are strong personalities, active players in the narrative. Sarah, like Abraham, “makes souls” (Genesis 12:5). God tells Abraham “in all that Sarah says to you, listen to her voice (obey her); for through Isaac shall your descendants be called. (gen 21:12) making Sarah as important a transmitter of covenant as Abraham. The other matriarchs are equally powerful players in the narrative, as are many other women in bible. The Talmud tells of the seven prophetesses in bible (BT Megillah 14a) including Deborah, the only person in the book of Judges to actually be seen making judgements for the Children of Israel  who came to her for rulings  (Judges 4:5). Women scholars can be found in our tradition down the years: Talmud records the comments if first century Ima Shalom,  In the 2nd Century Beruriah, daughter of Rabbi Hananiah ben Teradyon was such a scholar that Talmud tells us “she learned three hundred laws from three hundred teachers in one day” (BT. Pesachim 62b).  Rashi’s daughters learned Talmud.

We have archaeological evidence that there were women leaders in the ancient synagogues from the second century on, that they were active participants in ancient Jewish society long before the rabbinic period. Women have affected tradition through the generations, be it taking on mikveh for themselves or creating their own prayers and techines. Even the way we pray the amidah is based on Hannah’s prayer (BT Berachot 31). So why now as the rest of the world is waking to the benefits of women in public space of is one part of the Jewish world going in the other direction? And how can traditional Jews recite Eshet Chayil (Proverbs 31:10-31) which celebrates the  domestic and commercial skills of a good woman, and at the same time declare that the mere presence of a woman in the public sphere will cause licentious thoughts and so must be prevented at all costs?

The segregation of women in prayer and study is a case in point. Mechitza is sometimes cited today as the gold standard of orthodoxy – yet less than a generation ago many orthodox synagogues did not require such a barrier between the sexes. Its origin is neither biblical nor from Temple period – indeed it most likely entered Jewish practise in medieval times from the practises of the people among whom the Jewish people were living. According to Talmud there was only one day in the year when men and women were separated, on the exceedingly festive Simchat Beit Ha’Sho’eva.  (Sukkah 5:1) Fascinatingly, according to the Talmud, on this day in order to prevent too much rowdy behaviour, there was a rabbinic enactment (takkanah) to separate the men and women, and after some trial an error putting the men outside the courtyard and the women inside, then vice versa, the solution was hit upon – to build a gallery above the courtyard and to place the women safely above the fray. Fancy that- a rabbinic enactment changing the plans of the Temple! Imagine the daring to create an architectural reformation that goes against the original divine blueprint.

The Talmudic Rabbis are well aware of this huge dissonance and dislocation in the tradition in order to respond to the people and attempted to support it with a verse from Zechariah, and as all those who study or write response know, supporting verses from the prophetic books are not enough to create Halacha, and most certainly they are not of the category of biblical law. The sleight of hand would be amusingly audacious if it has not meant within the last generation or so that it has disappeared behind the “because I say so” school of responsa, and emerged as a biblical imperative that must not be questioned.

 The area of the Second Temple known as the Ezrat Nashim was not an area designated especially for women as is popularly imagined, but the first courtyard as one entered the Temple precinct and it is clear that both men and women mingled within it. There is no evidence – either textual or physical, that men and women were separated during public worship until the middle ages when we find the statement in the tenth century Tana D’vei Eliyahu that “a man should not stand among women and pray, because he is likely to be distracted by them” – a statement that seems to imply that men are indeed praying alongside women.  

So why in the last few years has one part of the orthodox world chose to focus on taking women out of public space? Why have the laws of tzniut (modesty) become not a spiritual aid, but a stick with which to beat girls and women, to force them to suppress much of their own selves as an act of piety. Posters abound in the frum world, such as the ones shown on this blog, warning women that if they do not wear suitably modest clothing the messiah will not come, they may cause ill health to others and even to themselves, the world is dependent on their covering up and ensuring that no one might notice them at all as women.  There are attempts to silence the voices of women in public, to prevent women singing even at secular events such as Israel Independence Day or Holocaust Memorial Day, although confusingly the responsa about what and where women may sing are so many and varied that what one rabbi may see as the worst possible time and place is noted by another as the only permissible way for women to sing….  And now women’s prayer minyanim are under attack, something that has happened throughout the ages in the Jewish world as attested by the many prayer books left behind, women praying together, studying and reading Torah together, are suddenly in the firing line for some rabbis determined to have a ruling calling them inauthentic, and outside the orthodox fold.

As a woman rabbi trained and working in a progressive stream of Judaism, this concerns me deeply. While I know enough to know how to challenge some of the so called traditions and see them in their context, and can read and critique the responsa which are steering this flight into a mind-set one cannot even really call medieval, I also know that there is a growing determination to control women as never before, and this worries me. Where is it coming from this strident male voice that is insisting that women are dangerous, that sexuality is impure, that authenticity can be found in a mind set so far from biblical and most rabbinic sources as to be from a different world. What is happening in some parts of the Jewish world that it is consuming not only the rights to self expression of women, but also the dynamism and scholarship and thoughtfulness of so many years in order to make a one size fits all costume to clothe and smooth away and hide from view the diversity, the openness and the audacity of our rabbinic ancestors.
